the overtaking is done on the right;
the traffic in the junction is regulated by a police officer or through traffic signals; or
It is clear from the road signs or other circumstances that drivers on the intersecting road have an obligation to give way or stop." This bullet relates to the question. If you can see that intersecting traffic is giving away you can overtake but have to do it in a safe manner
